Delhi court has granted bail to Sharjeel Imam.
Imam will remain in jail for other cases.
The court observed Imam's speech was on communal lines.
Imam is also accused of being the "mastermind" of the February 2020 northeast Delhi riots.
The court asked the Tihar Jail superintendent as well as the IO to intimate it about the time when the custody of the accused is handed over to the police officials concerned
The court permitted Hussain's counsel to confer with him for a period not exceeding half an hour at the beginning of the ED custody
"After expiry of the ED custody, the IO shall hand over the custody of the accused to the jail superintendent who shall follow the protocol regarding the COVID-19," it said
The lower court, however, is yet to take cognizance of 125 cases in which charge sheets have been filed.
Probing the conspiracy of Delhi riots, the Delhi police had earlier arrested Tahir Hussain who is also accused in the murder case of IB officer Ankit Sharma during the northeast Delhi violence.
The plea seeks a declaration of the CAA as "ultravires to the provision of the Constitution of India and is declared as void".
The agitations were being held against the Citizenship Amendment Act, National Population Register and National Register of Citizens, even demanding that the state assembly pass a resolution against the CAA.
Delhi Lt. Governor Anil Baijal has appealed people to restoring peace and maintaining law and order and communal harmony in view of the violence in some parts of Delhi.
The apex court fixes the matter for further hearing to March 23. The court also termed incidents of violence in Delhi as unfortunate but refused to entertain pleas on them.
In a midnight hearing, the Delhi High Court directed police to ensure safe passage and emergency treatment for those injured in the recent violence over the amended citizenship law in northeast district of Delhi.
