A Parliamentary committee on Thursday said that appointment of judges to the higher judiciary is essentially the function of the executive.
There is no proposal being considered now to amend the Constitution to allow reservation in higher judiciary but the issue needs to be looked into at some point of time, government said on Thursday.
The Supreme Court is likely to pronounce on Wednesday its order on improving the functioning of the collegium and bringing transparency in the appointment of judges to the higher judiciary including the apex court.
CJI Tirath Singh Thakur also said he would embark on this exercise only after the five-judge constitution bench spells out a transparent procedure of appointing judges.
This is for the first time the Law Minister has spoken in Parliament on the SC verdict on NJAC Act.
The government is believed to be upset after its bid to replace the collegium system was thwarted by the Supreme Court recently.
The government's stand came in the wake of apex court's November 3 order seeking suggestion for improving the working of the collegium.
Finance Minister Arun Jaitley has said that the SC decision on NJAC would not lead to any confrontation between the government and the judiciary.
In a judgement with far-reaching consequences, the Supreme Court on Friday struck down the NJAC Act holding it unconstitutional.
