Lt Col Prasad Purohit was not performing his official duty when indulging in the activity of bomb explosion, said the Bombay High Court.
The HC on Monday while refusing to discharge him in the September 2008 Malegaon blast case.
Purohit and six others, including BJP MP Pragya Singh Thakur, are facing trial in the case.
Purohit had asked for statements of all the witnesses from ATS and NIA charge sheet.
The trial court had earlier in the day rejected one of the accused Lt Col Prasad Shrikant Purohit's plea to defer the framing of charges and said that the charges are ready.
The Bombay High Court had on Monday refused to stay framing of charges by the trial court against Purohit and other accused in the Malegaon blast case.
NIA alleged that "in a secret meeting held at Faridabad, Purohoit proposed for a separate Constitution for Hindu rashtra with separate saffron flag.
The NIA alleged that on January 25-26 "in a secret meeting held at Faridabad, Purohoit proposed for a separate Constitution for Hindu rashtra with separate saffron flag.
Lieutenant Colonel Purohit is also an accused in the bombing in Malegaon area of Maharashtra on September 29, 2008.
