A five judge-judge Constitution bench in October 2023 had held that there is no unqualified right to marriage and same-sex couples cannot claim that as fundamental right. 

Same-Sex Marriage: A five-member Constitution Bench led by Chief Justice of India, DY Chandrachud, emphasized that assuming only "heterosexual married couples can be good parents" is unfounded and discriminatory.

This comes after the Centre, in its affidavit, had opposed the plea seeking legal recognition of same-sex marriage, saying that living together as partners by same-sex individuals, which is decriminalised now, is not comparable with the Indian family unit and they are clearly distinct classes which cannot be treated identically.
